These terms govern your use of vancekillen.com (the "Site"), operated by Vance Killen Interior Design ("we," "us," or "our"). By visiting or using the Site, you agree to them. If you do not agree, please do not use the Site.
What this website is
The Site is a portfolio. It exists to show our work, describe our practice, and give prospective clients a way to reach us.
Nothing on the Site is an offer to enter into a contract, a quote, a price commitment, or a guarantee of availability. Viewing the Site, emailing us, or calling us does not create a client relationship or any obligation on either side.
These terms do not govern design services
If we go on to work together, that engagement is governed entirely by the written agreement we sign with you. That agreement covers scope of work, fees, schedules, procurement, purchasing, revisions, termination, and every other term of the project.
Nothing on this page modifies, supplements, or overrides a signed agreement. Where anything here conflicts with a signed agreement, the signed agreement controls.
Ownership of content
The content on this Site, including project photography, written descriptions, page design, layout, and the Vance Killen Interior Design name and marks, is protected by copyright, trademark, and other intellectual property laws.
Some of that content we own. Some of it, particularly project photography, is used under license from the photographers and other rights holders who created it, and those parties retain their own copyright. Either way, none of it is yours to use.
What you may and may not do with the content
You may view the Site, and you may print or save individual pages for your own personal, non-commercial reference.
Without our prior written permission, you may not:
Copy, republish, redistribute, or publicly display any content from the Site
Use any project photography in marketing, portfolios, mood boards, presentations, or social media, whether or not you credit us
Create derivative works from any content on the Site
Use automated tools to scrape, crawl, harvest, or systematically download content from the Site
Use any content from the Site to train, fine-tune, or develop machine learning or artificial intelligence models
Frame the Site, or any part of it, within another website, or present our content as your own
Remove, obscure, or alter any copyright notice, credit, or watermark
Interfere with the operation or security of the Site, or attempt to gain unauthorized access to it
Because some images are licensed rather than owned, we cannot grant permission to reuse them even when we would like to. Requests to license project photography should still come to us, and we will direct you to the appropriate rights holder.
Copyright concerns
We make a good-faith effort to publish only content we own or are licensed to use. If you believe something on this Site infringes your copyright, email us at vance@vancekillen.com with a description of the work, the page it appears on, and your contact information. We will review it promptly and remove anything we do not have the right to publish.
Accuracy of content
We work to keep the Site accurate and current, but we make no promise that it is. Project descriptions, materials, sources, availability, and contact details may change without notice. Photography may not reflect a space as it exists today.
Content on the Site is presented for general information and is not professional advice. Nothing here should be relied on as design, architectural, structural, engineering, code compliance, or safety guidance for your own project. Design decisions depend on conditions we have not seen and requirements we have not reviewed.
Links to other websites
The Site may link to publications, press coverage, vendors, trade partners, and other third-party websites. We do not control those sites and are not responsible for their content, accuracy, availability, or privacy practices. A link is not an endorsement.
Availability of the Site
We do not guarantee that the Site will be available without interruption or free of errors. We may change, suspend, or discontinue any part of it at any time, without notice.
Disclaimer of warranties
The Site and everything on it are provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Limitation of liability
To the fullest extent permitted by law, Vance Killen Interior Design and its owners, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of your use of, or inability to use, the Site.
Nothing in these terms limits or excludes liability for fraud, willful injury, or any other liability that cannot be limited or excluded under California law.
Indemnification
You agree to indemnify and hold harmless Vance Killen Interior Design from any claim, demand, loss, or expense, including reasonable attorneys' fees, arising out of your misuse of the Site or your violation of these terms or the rights of any third party.
Privacy
Our handling of information collected through the Site is described in our Privacy Policy, which forms part of these terms.
Accessibility
We are committed to keeping this Site usable by as many people as possible. Our current conformance status, known limitations, and how to report a barrier are described in our Accessibility Statement.
Changes to these terms
We may update these terms from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of the Site after a change takes effect means you accept the revised terms. We encourage you to review this page periodically.
Governing law and venue
These terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of or relating to these terms or your use of the Site will be brought exclusively in the state or federal courts located in Monterey County, California, and you consent to the jurisdiction of those courts.
Severability and entire agreement
If any provision of these terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full effect.
These terms, together with our Privacy Policy, are the entire agreement between you and us regarding your use of the Site. They do not replace any signed client agreement.
